Inspection of the Civil Service System
Within the Inspection of the Civil Service System, the inspectors oversee the implementation of the provisions of the Public Employees Act and the implementing regulations issued on the basis thereof, the Public Sector Salary System Act and the implementing regulations issued on the basis thereof, and the provisions of collective agreements and employers’ internal rules (in relation to the salaries of officials and public employees). Moreover, the Inspection also provides supervision of the Implementation of the Republic of Slovenia Budget Act in sections related to personnel plans and employment.
The Public Sector Salary System Act and the general provisions of the Public Employees Act (i.e. the first part of the Act) apply to state authorities and bodies of self-governing local communities, public agencies, public funds, public institutes and other public law entities which are indirect users of the state budget. The second part of the Public Employees Act (Articles 22 et seq.) applies to state authorities and administrations of self-governing local communities. The Implementation of the Republic of Slovenia Budget Act must be applied by all budget users.
Motion handling
Motions for supervision are first addressed as information on alleged irregularities.
After receiving such a motion, the Inspectorate responds to the initiator with information about the manner in which the motion will be handled and any other relevant detail.
Supervisions are conducted in accordance with the annual plan of work and the current orientations and priorities.
Implementation of inspections and measures
Inspections are carried out as an internal control procedure subject to special arrangements. The inspector is obliged to issue a record on inspection findings in which measures to remedy irregularities are imposed on the person subject to the inspection if such are established. An objection may be filed against a particular record by the Head (i.e. the responsible person of the budget user) within eight days of the service of the record of the implemented inspection. The objection is decided by the minister responsible for public administration. The decision of the minister forms an integral part of the record (if the objection and the minister’s decision refer to the Public Sector Salary System Act). Where measures have been imposed on the person subject to the inspection by means of a record, this person is obliged to send a report on their implementation to the inspector within the specified period of time. Once the measures have been implemented, the inspection is concluded with the issue of a final record. After the concluded inspection, the inspector informs the initiator of the findings (if the inspection was carried out under the Public Employees Act) and/or, upon the initiator’s request, provides information on the measures imposed (if the inspection was carried out under the Public Sector Salary System Act).
